Irked by faulty drain, Rose Lane Chanapora inhabitants take legal recourse

Irked by failure of authorities to restore faulty drain in the area, the residents of Rose Lane Colony, Chanapora here have taken legal recourse by filing a writ petition seeking registration of FIR against the concerned engineers.

Senior Advocate Bashir Ahmad Bashir has filed the writ petition in representative capacity on behalf of the residents.

“Due to the faulty drain, compounds of houses in the colony are inundated. The deep drain has been constructed at an expenditure of whooping Rs. two crore without following prescribed norms or using engineering expertise. Wrong alignment of the drain has resulted in stagnation of water,” said Senior Advocate, Bashir Ahmad Bashir, who is also a resident of Rose Colony, Chanapora.

“Ironically, despite construction of a shed, the concerned engineers have failed to install motor there to pump out the drain water. Even the irrigation canal passing through the area has become a cesspool in absence of cleaning from years together. The pungent smell emanating from the canal has created health problems to the inhabitants,” the petitioner said.

The petitioner is seeking registration of FIR against all concerned officials for construction of this faulty drain and non-maintenance. “These officials have caused huge loss to the exchequer besides innumerable problems to the residents,” he said.

Hearing the petition, Justice MH Attar issued notices to respondents, Commissioner SMC, Chief Engineer Mechanical division, Vigilance Commissioner and Executive Engineer of R&B.
Pertinently, Greater Kashmir has carried many reports highlighting problems faced by the inhabitants of Rose Lane and adjoining Garden lane due to construction of faulty drains.
